La discapacidad permanente para cada parte del cuerpo lesionada puede ser causada por la lesi\u00f3n laboral y condiciones m\u00e9dicas preexistentes, raza, g\u00e9nero, gen\u00e9tica, edad y otros factores que restan a los trabajadores lesionados las indemnizaciones por discapacidad permanente.<\/p>\n<p>Una condici\u00f3n preexistente puede ser una:<\/p>\n<ul class=\"bullets bullets bullets\">\n<li>lesi\u00f3n no relacionada con el trabajo<\/li>\n<li>condici\u00f3n m\u00e9dica no relacionada con el trabajo<\/li>\n<li>lesi\u00f3n laboral previa<\/li>\n<\/ul>\n<p>La distribuci\u00f3n reduce la discapacidad laboral permanente de un trabajador lesionado de California. Esto reduce el valor en efectivo de su reclamo en adjudicaciones y acuerdos de compensaci\u00f3n para trabajadores.<\/p>\n<p>Tambi\u00e9n hay prorrateo cuando un trabajador lesionado tiene dos o m\u00e1s lesiones laborales al mismo tiempo. A cada lesi\u00f3n se le asigna un valor porcentual separado. Esto tiene un valor en d\u00f3lares m\u00e1s bajo que si las lesiones se combinan. La compensaci\u00f3n para trabajadores debe pagar toda la atenci\u00f3n m\u00e9dica, incluso si hay\u00a0<strong>prorrateo<\/strong>\u00a0a un\u00a0<strong>condici\u00f3n preexistente<\/strong>.<\/p>\n<p>Este proyecto de ley prohibir\u00eda el uso de la raza, la edad, el g\u00e9nero, el sexo o las caracter\u00edsticas gen\u00e9ticas al asignar la discapacidad permanente a factores no industriales. B\u00e1sicamente, esto significa que su m\u00e9dico puede afirmar que el 50% de su lesi\u00f3n est\u00e1 relacionado con el trabajo y el 50% de su lesi\u00f3n se debe a la degeneraci\u00f3n relacionada con la edad, aunque no tenga s\u00edntomas y est\u00e9 haciendo su trabajo bien hasta que se lesion\u00f3.<\/p>\n<p>Si se lesion\u00f3 en el trabajo, lo m\u00e1s probable es que experimente alguna forma de distribuci\u00f3n cuando se realice una evaluaci\u00f3n permanente y estacionaria, a menos que se recupere de los efectos de su lesi\u00f3n laboral sin ning\u00fan impedimento.
