{"id":1286,"date":"2015-06-23T09:36:44","date_gmt":"2015-06-23T16:36:44","guid":{"rendered":"https:\/\/www.clevelandmetzlaw.com\/?p=1286"},"modified":"2021-03-03T10:17:02","modified_gmt":"2021-03-03T18:17:02","slug":"prestaciones-de-accidentes-de-trabajo-120-millones-fondo-de-reinsercion-laboral","status":"publish","type":"post","link":"https:\/\/www.clevelandmetzlaw.com\/es\/workers-compensation-benefits-120-million-return-to-work-fund\/","title":{"rendered":"Beneficios de compensaci\u00f3n para trabajadores: $120 Million Return to Work Fund"},"content":{"rendered":"<h1>Beneficios de compensaci\u00f3n para trabajadores: $120 Million Return to Work Fund<\/h1>\n<p>Todos somos conscientes del efecto devastador que SB 863 ha tenido en los beneficios de compensaci\u00f3n para trabajadores, especialmente <a href=\"https:\/\/www.clevelandmetzlaw.com\/wp-content\/uploads\/2014\/10\/Work-injury-Study.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-1180\" src=\"https:\/\/www.clevelandmetzlaw.com\/wp-content\/uploads\/2014\/10\/Work-injury-Study-300x226.jpg\" alt=\"Beneficios de compensaci\u00f3n para trabajadores: $120 Million Return to Work Fund\" width=\"300\" height=\"226\" \/><\/a>con respecto al acceso de los trabajadores lesionados al tratamiento m\u00e9dico. Una de las pocas concesiones para trabajadores lesionados que surgi\u00f3 de la SB 863 fue la implementaci\u00f3n de la Secci\u00f3n 139.48 del C\u00f3digo Laboral. Esta secci\u00f3n cre\u00f3 el Programa Suplementario de Retorno al Trabajo (RTW), que se financia anualmente por un monto de $120 millones para proporcionar pagos suplementarios a los trabajadores cuyos beneficios por discapacidad permanente son desproporcionadamente bajos.<\/p>\n<p>El 13 de abril de 2015, las regulaciones del Programa de Suplementos RTW finalmente entraron en vigencia. (reg. 17300-17310). El programa se basa en los resultados de estudios realizados por RAND en febrero de 2014 titulados &quot;Identificaci\u00f3n de trabajadores discapacitados permanentemente con p\u00e9rdidas desproporcionadas de ingresos para pagos suplementarios&quot;.<\/p>\n<p>La elegibilidad para los fondos del programa es bastante simple, un trabajador lesionado debe haber sufrido una lesi\u00f3n industrial el 1\/1\/13 o despu\u00e9s.\u00a0<strong>y<\/strong>\u00a0debe haber recibido un vale de beneficio suplementario por desplazamiento de trabajo por esa lesi\u00f3n de conformidad con LC Sec 4658.7. Bajo Reg 17308, el monto del pago del fondo es $5,000 para un trabajador lesionado elegible. Sin embargo, existe un plazo estricto para que nuestros clientes presenten la Solicitud para el beneficio del programa RTW y deben solicitarla electr\u00f3nicamente.<\/p>\n<p>La fecha l\u00edmite para que nuestros clientes presenten la solicitud es dentro de un a\u00f1o a partir del 13 de abril de 2015 o dentro de un a\u00f1o desde que se entreg\u00f3 el vale de Beneficios Suplementarios por Desplazamiento del Trabajo (SJDB) al trabajador lesionado.\u00a0<strong>lo que ocurra m\u00e1s tarde.\u00a0\u00a0<\/strong>Adem\u00e1s, para los vales de SJDB emitidos despu\u00e9s del 13 de mayo de 2015, el transportista debe adjuntar un aviso, junto con el vale, al trabajador lesionado explicando su elegibilidad para los beneficios bajo el programa de fondos RTW. (reg. 17303)<\/p>\n<p>Entonces, \u00bfqu\u00e9 pasa con los clientes que recibieron su cup\u00f3n antes del 13 de mayo de 2015? No hay nada en las regulaciones que requiera que el Demandado informe al trabajador lesionado sobre su derecho al beneficio del programa RTW. Si tiene un cliente que sufri\u00f3 una lesi\u00f3n industrial despu\u00e9s del 1\/1\/13 y ya ha recibido un vale de beneficio suplementario por desplazamiento del trabajo por esa lesi\u00f3n, se le debe informar que tiene hasta\u00a0<strong>13 de abril de 2016\u00a0<\/strong>para solicitar este pago de $5,000 del fondo del programa RTW.<\/p>\n<p>Para solicitar el pago del programa RTW, la solicitud debe enviarse solo en l\u00ednea (sin presentaciones en papel) y requerir\u00e1 una computadora, esc\u00e1ner e impresora. Adem\u00e1s, nuestros clientes deben presentar la solicitud de pago por su cuenta, no existe ninguna disposici\u00f3n que permita que la solicitud sea presentada por su abogado. Si su cliente no tiene acceso a una computadora, esc\u00e1ner e impresora, tendr\u00e1 que viajar a la oficina de distrito del Departamento de Compensaci\u00f3n para Trabajadores (DWC) m\u00e1s cercana para usar la computadora a fin de enviar la solicitud de fondos. El estatuto de un a\u00f1o no comienza a correr hasta que se les entregue el vale.<\/p>\n<p>Si el Director rechaza la solicitud del trabajador lesionado para el pago del programa RTW, \u00e9l o ella puede apelar esa determinaci\u00f3n ante la WCAB. (reg. 17309)<\/p>\n<p>Han pasado casi 3 a\u00f1os desde la aprobaci\u00f3n de la SB 863, y algunas de las regulaciones que se ordenaron entrar en vigencia hace dos a\u00f1os se han implementado recientemente. Uno de los conjuntos m\u00e1s intrigantes de las nuevas regulaciones involucr\u00f3 la creaci\u00f3n del Programa Suplementario de Regreso al Trabajo.
